====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Balrampur P.S. Case No. 21 of 2019, instituted for the offence under Section (s) 30(a) of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that 268.500 litres of foreign liquor has been recovered from pick up van. On seeing the police party, Driver and Khalasi of the pick up van started running away. They were apprehended by the police. They disclosed their names as Chhotu Kumar Sahni and Rishi Raj Kumar (petitioners).

Counsel for the petitioners submits that petitioners

Patna High Court CR. MISC. No.26995 of 2019(2) dt.26-04-2019 2/2 have no concern with the aforesaid liquor. They are in custody since 16.2.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. 2nd cum Special Judge, Katihar, in connection with Balrampur P.S. Case No. 21 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners.
