The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per F.I.R., all the accused persons including petitioner came to the shop of the informant, where mother of informant was sitting, and it is alleged that this petitioner abused and assaulted her with iron rod, as a result of which, she received injury on her head and when informant came to save her mother, he was also assaulted by co-accused Ansu Kumar. It is submitted on behalf of petitioner that though, there is allegation of causing assault with iron rod on the head of mother of informant, but doctor has found simple injury. There is case and counter case and both sides sustained injury. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.28037 of 2022(3) dt.21-11-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM - II, Munger in connection with Bariarpur P.S. Case No. 101 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
