The petitioner apprehends his arrest in connection with CIII 229 of 2018 registered under Section 30(A) of the Bihar Excise Act, 2016.

The accusation is that in course of patrolling duty when the informant being Excise Inspector and other officials reached at the bank of Taru river then some persons started to flee away. While informant and others chased to them but they succeeded to flee away. On search, 1795 bottles each containing 180 ml Indian made foreign liquor were recovered from the ditch situated at the bank of Taru river. At that time, informant came to know that petitioner, Birendra Yadav and Dhananjay

Learned counsel for the petitioner submits that petitioner has not been apprehended at the spot but his name has falsely been implicated in this case mere on suspicion. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge (Excise), Siwan, in connection with CIII 229 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
