JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Parbatta P.S. Case no. 274 of 2017, registered under Sections 448, 427, 327, 353, 283 and 504/34 of the Indian Penal Code. The accusation is that on 13.08.2017, 12 persons named in the F.I.R. including the petitioners and 50-60 unknown men and women reached at the gate of power grid and started entering in the gate and damaged the materials kept there. At that time, informant, who is Guard in the power grid, was dragged out from the gate and

Learned counsel for the petitioners submits that, in fact, due to irregular supply of the electricity the villagers made protest at the gate of the power grid in which petitioners were member of the mob, but no occurrence of Marpit or pulling out the informant took place there, only to save skin against the protest of the villagers the present case has been lodged. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No. 274 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
