The petitioner, who is wife of brother of husband of the deceased apprehending her arrest in Sheohar P.S. Case No. 83 of 2015 registered for the offence under Section 498(A), 302, 201/ 34 of the Indian Penal Code has prayed for grant of bail. It was submitted by learned counsel for the petitioner that save and except the fact that petitioner is wife of brother of the husband of the deceased, there is no other material to show involvement of the petitioner.
Learned Additional Public Prosecutor after going through the case diary and material which has been collected till
Patna High Court Cr.Misc. No.47187 of 2016 (4) dt.16-12-2016 2/2 date submits that there is no direct accusation against the petitioner and investigation is still going on. Considering the facts and circumstances , in the event of arrest or surrender within a period of six weeks from today, let the petitioner Reena Giri be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar / concerned court in connection with Sheohar P.S. Case No. 83 of 2015 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure 1973.
It is made clear that if during investigation further material is collected against the petitioner and petitioner is arrayed as accused in column no. 11 of the charge sheet and forwarded as accused, in that event, her bail bond shall stand automatically cancelled, thereafter she will have to appear and make a prayer for regular bail.
