JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends her arrest in connection with Hilsa P.S. Case No. 481 of 2017, registered for the offences punishable under Sections 353, 504, 332 of the Indian Penal Code. Allegedly, when the informant and other police personnels tried to make search of the house of Kameshwar Mahto then the petitioner obstructed them and assaulted the informant with broom, resulting, the house was not searched and it was learnt that from the said house firing was done and in the house arms were kept.

Submission is of false implication and that the petitioner is unmarried girl, she has filed Complaint Case No. 432 of 2017 and thereafter this case has been lodged. As a matter of

No.52246 of 2017 (2) dt.09-11-2017 2/2 fact, the petitioner was misbehaved and her ornaments were snatched by accused Ravindra Ravidas, Ravindra Ravidas and Manoj Ravidas are the agent of the police. The informant of this case also caused threats and misbehaved with the petitioner and for that the complaint case has been lodged and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, considering that the petitioner has also lodged complaint case which is going on and further considering that the petitioner is unmarried girl and, as such, she in the event of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nalanda, Camp Court, Hilsa, in connection with Hilsa P.S. Case No. 481 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
