2. Earlier the bail of the petitioner was rejected twice and this is the third attempt for grant of regular bail.

3. The petitioner seeks bail in connection with Lodipur P.S. Case No. 300 of 2022 registered for the offence under Sections 147, 148, 149, 341, 323, 307 of the Indian Penal Code; Sections 25(1-b)a, 26, 27, 35 of the Arms Act and under Section 3⁄4 of the Explosive Substance Act.

4. It has been submitted by learned counsel for the petitioner that the petitioner is in jail since 13.12.2022.

5. The report of the trial Court shows that the charges have already been framed on 22.12.2023 and no witnesses have been examined.

6. The Senior Superintendent of Police, Bhagalpur is directed to produce the witnesses on the date fixed in the trial. It is the responsibility of the Senior Superintendent of Police, Bhagalpur to get the witnesses examined on the date fixed.

7. This application is again dismissed.

8. Let a copy of this order be communicated to the Senior Superintendent of Police, Bhagalpur and the District Magistrate, Bhagalpur forthwith through FAX or e-mail for its compliance.
