Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 399 and 402 of the IPC and Section 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has antecedent of 13 cases and is in custody since 1-72019 and the informant alleges that petitioner was apprehended along with Shipu and Vikash and on search one country-made pistol loaded with two cartridges were recovered. 4.

Learned counsel for the petitioner submits that petitioner is in custody since 1-7-2019 in respect of an offence under the Arms Act. It is also submitted that charges have been

Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that petitioner has antecedent of 13 cases and in the event if privilege of bail is granted to the petitioner, the petitioner may abscond, on which the learned counsel appearing on behalf of the petitioner submits that petitioner will not abscond rather will cooperate in the trial to prove his innocence that he has been implicated in the instant case only because of his antecedents.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Digha P.S. Case No. 370 of 2019.

One of the bailors of the petitioner shall be his cousin brother, Ranjeet Kumar, who has sworn the affidavit. 8.

However, it is made clear that if the learned trial court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial court
