This is an appeal under section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, (hereinafter in short referred to as the 'SC/ST Act') against the refusal of prayer for bail vide order dated 01.04.2021, passed by learned Additional District and Sessions Judge-1-cum-Special Judge, Kaimur at Bhabua in connection with Karamchat P.S. Case No. 57 of 2020, registered under Sections 302, 406, 420, 120B of the IPC, Section 27 of the Arms Act and Sections 3(i) (r) (s) of SC/ST Act.

Appellant is said to have abused the informant by taking her caste name and also assaulted her. Learned counsel for the appellant submits that appellant is innocent and has been falsely implicated in this

He submits that similarly situated co-accused has been granted bail by coordinate Bench of this Court vide order dated 26.03.20211 in Cr. APP No. 1325 of 2021. He further submits that appellant has no criminal antecedent as stated in para-3 of this appeal and he is languishing in judicial custody since 21.10.2020.

However, learned Spl. PP for the State and respondent no. 2 oppose the prayer for bail and submit that the appellant is involved in the present case and all the witnesses have supported the prosecution story.

Considering the facts and circumstances of the case, I am not inclined to enlarge the appellant on bail. Accordingly, his payer for bail is rejected in connection with Karamchat P.S. Case No. 57 of 2020 pending before the court of the learned Additional District and Sessions Judge-1-cum-Special Judge, Kaimur at Bhabua.

Accordingly, the appeal is dismissed. However, trial court is directed to expedite the trial.
