The petitioners apprehend their arrest in Tariyani P.S. Case No. 106 of 2016 registered for the offences punishable under Section 307 and some other Sections of the Indian Penal Code. The informant Chandradeo Paswan named eight persons including all these six petitioners and alleged that they having armed with different weapons came to his Darwaja. Ram Sanjeevan Paswan assaulted the informant with iron rod on his head and Gauri Paswan assaulted him with iron rod which caused fracture injury on hand and head.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.45783 of 2016 (2) dt.28-11-2016 2/2 informant did not make any specific allegation against the petitioners. There is a counter version being Tariyani P.S. Case No. 108 of 2016.
Considering the facts that no specific allegation of assault is made against the petitioners and there is a counter version also, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar in Tariyani P.S. Case No. 106 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
