JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-01-2018 The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Sadar P.S. Case No. 193 of 2016 dated 26.05.2016 instituted for the offences under Sections 409, 120B, 467, 468, 471 read with Section 34 of the I.P.C. The petitioner was, at the relevant time, Block Agriculture Extension Officer, Goraul in the District of Vaishali. It has been alleged in the F.I.R. that there were major irregularities in the supply of agricultural implements to the farmers under the Agriculture Implementation Project, 2015. In an enquiry which was conducted by a team comprising the informant, it was found that the petitioner and anothers in their capacity as Block Agriculture Extension Officer and other functionaries of the Agriculture Department had caused losses of several crores to the Government exchequer by committing

Mr. Bindhyachal Singh, learned counsel for the petitioner has submitted that a vague statement has been made in the F.I.R. and till date, during the course of investigation, it has not come to light as to how it was found by the enquiry team that the irregularities were committed in the supply of agricultural implements to the beneficiaries. It has further been submitted by Mr. Singh that one of the Block Agriculture Extension Officer of a different block, having similar allegations against him, has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 19.08.2017 passed in Cr. Misc. No. 36731 of 2017.
For lack of any details regarding the manner in which the irregularities were committed, this Court feels inclined to grant anticipatory bail to the petitioner.
In the facts stated above, the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail subject to his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate
