KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 09-09-2020 Petitioner has prayed for the following relief/s: "(i) For issuance of direction to the respondent authorities to amend clause 1 (v) (g) of Memo No.1098 dated 22.08.2019 and make same provision for the Arts student which has been made in column 1 (v) with respect to student of B.Sc. (Biotechnology) and B.Sc. (Electronics) as the person who got admission in B.Ed. On the basis of their B.Sc. (Biotechnology) and B.Sc. (Electronics) and studied physics/chemistry/biology as one of

Have been declared to be eligible for appointment of teacher for the vacancies of Mathematics and Science in Upper Primary School (Middle School) in the State of Bihar, whereas the students who studied Hindi as Method Paper in B.Ed. have been discriminated and have not been found eligible for the appointment of teacher for the vacancies of subject Hindi.

(ii) The petitioner further prays that the respondent authorities be directed to allow the petitioner to submit her application as against the vacancies of Hindi subject as the petitioner completed her B.Ed. in Home Science and got admission in B.Ed. and thereafter studied Hindi as a method paper but he is not being allowed to submit her application as against the vacancy of Hindi and further her application be treated to be valid for the purpose of recruitment as against the vacancy of subject Hindi for the appointment in Upper Primary School (Middle School)."

Learned counsel for the petitioner states that the case pertaining to similarly situated persons already stands considered. As such petitioner shall approach the respondent authorities seeking similar relief.

Learned counsel for the petitioner prays that the petition be disposed of for consideration of the petitioner's representation in accordance with law. For this none can have any objection.

As such, the present petition is disposed of in the following terms : (a) This Court has not expressed any opinion

Patna High Court CWJC No.7487 of 2020(2) dt.09-09-2020 3/3 on the merits of the matter and (b) as and when the petitioner makes a request to the authorities concerned pointing discrimination, if any, the same shall be considered and decided by the authorities in accordance with law.

We only hope and expect that the authorities to take decision expeditiously and preferably within a period of two months from the date of receipt of such request. Liberty is reserved to the petitioner to approach this Court if any subsequent cause of action arises.
