This application for grant of regular bail arises out of Bakhari P.S. Case No. 199 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 28.02.2020 passed in Cr. Misc. No. 10305 of 2020.
Allegedly, from the premises belonging to the petitioner, the police recovered 288 bottles of illicit Indian made foreign liquor. It is stated in this application that the petitioner has no criminal antecedent, who is in custody since 04.02.2020 in connection with the aforesaid Bakhari P.S. Case No. 199 of 2019.
Considering the petitioner's period of custody and
Patna High Court CR. MISC. No.30510 of 2020(2) dt.22-01-2021 2/2 the fact that there is no likelihood of the trial being concluded in near future, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Begusarai, in Bakhari P.S.
