This application, for grant of anticipatory bail, arises out of Beldour Police Station Case No. 226 of 2017, disclosing offences under Sections 147, 148, 149, 323, 379, 435, 436 and 504 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner and no specific overt act is attributed to her. Learned counsel for the petitioner has further submitted that co-accused, Dilip Paswan and Prashant Kumar, having more or less similar allegation have been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 9123 of 2018. Hence, the
Patna High Court Cr.Misc. No.30943 of 2018 (2) dt.05-06-2018 petitioner, who is a lady, deserves the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 3rd, Khagaria, in connection with Beldour Police Station Case No. 226 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
