2. The petitioner seeks bail in connection with Suppl. Khagaria P.S. Case No. 89 of 2023 registered for the offence punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.
3. The petitioner has not been put on Test Identification Parade. From the materials available on record it has come that the petitioner is a drug addict. The three miscreants who had committed the crime have been identified in Test Identification Parade. The petitioner is not one of the accused who is said to have committed the crime. The petitioner is in jail since 24.01.2024.
4. Learned APP appearing for the State opposes the
Patna High Court CR. MISC. No.30939 of 2024(3) dt.20-07-2024 2/2 prayer for regular bail of the petitioner.
5. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Suppl. Khagaria P.S. Case No. 89 of 2023.
6. The petitioner will also mark attendance in Khagaria Police Station, Khagaria on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
