The petitioners are apprehending their arrest in a case registered under Sections 147, 148,149, 332, 353, 337, 323, 427, 435, 153(A), 506, 504, 283 and 307 of the Indian Penal Code. Accusation is that the accused persons including the petitioners and 400-500 miscreants blocked the main road due to death of one Naresh Kewat of village and when the police party interfered the uncontrolled crowds started pelting stones and bricks over the police party, on account of which some police personnel sustained injuries.
It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.50234 of 2016 (3) dt.13-01-2017 2/2 the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made. No specific overt act has been alleged against the petitioners. The other co-accused have been granted anticipatory bail vide Cr.Misc.No.42571 of 2016.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. case No.90 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
