For the Petitioner/s :

Mr. AJAY BIHARI SINHA, GA-8 ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date : 13-10-2017 The only direction issued in the writ petition was that the representation of the petitioner be considered and from the counter affidavit and the show cause filed by the respondents it is clear that the admitted claim, as per respondents' calculation, has been paid, though the applicant disputes the aforesaid by filing a second rejoinder.

As the order passed was only to pay the admitted claim, now the dispute arising out of the disputed claim cannot be considered in this contempt application. The same gives a fresh cause of action to the petitioner, but not a case to initiate action for contempt. As the admitted claims have already been paid, no further action is required to be taken in the matter.

Patna High Court MJC No.1360 of 2014 dt.13-10-2017 2/2 The application is disposed with liberty to the applicant to challenge the rejection of the full claim in accordance with in an appropriate proceeding before an appropriate forum.
