JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 350 of 2019, arising out of Excise Case No. 06 of 2019 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 11.03.2019. He further submits that in the instant case total 104.39 litres of liquor was seized from Maruti Zen. He also submits that the petitioner is not the owner of the vehicle nor concerned with the seized liquor. He submits that the petitioner has been arrested in the instant case because he has taken lift from the aforesaid vehicle.
