At the outset of the argument, it is admitted at the bar that the petitioner, against the order of punishment by the disciplinary authority, did not exhaust the alternative remedy by way of appeal before the Commissioner.

In view of this fact, this writ petition is permitted to be withdrawn with liberty to the petitioner to file appeal before the Commissioner or competent authority within two months from the date of this order and the appellate authority shall dispose of the appeal of the petitioner within two months thereafter. This writ petition is disposed of as withdrawn with the liberty, as aforesaid.
