The petitioners apprehend their arrest in Gaighat P.S. Case No.234 of 2017 registered under Section 307 and other Sections of the Indian Penal Code.

The informant, Nagendra Singh alleged that Parmanand Paswan was playing loudspeaker. On protest, the accused persons assaulted the informant and his family members. The learned counsel for the petitioners submits that there is a case and counter case being Gaighat P.S. Case No.233 of 2017 which has been lodged on behalf of the petitioners. From perusal of the injury report, as contained in Annexure 3 series, it would appear that all the injured got simple injuries. From the side

Patna High Court Cr.Misc. No.29423 of 2018 (2) dt.18-05-2018 of the petitioners also, many persons got injury. Considering the facts that there is a case and counter case and both sides entered into mutual assault with each other, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-cum-Sub Judge 16th, Muzaffarpur in connection with Gaighat P.S. Case No.234 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
