The petitioners apprehend their arrest in Karmchat P.S. Case No. 34/2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named the petitioners along with other accused persons and alleged that Pappu Ram, Chhotan Ram were forcibly constructing house on his land. An altercation took place and the accused persons assaulted the informant and others. Petitioners Phulmati Kuwar and Rina Devi are alleged to have assaulted Prema Kuwar with plank of wood causing injury on her head.

Patna High Court Cr.Misc. No.41394 of 2016 (2) dt.18-11-2016 2/2 Learned counsel for he petitioners submits that there is a counter version bearing Karmchat P.S. Case No. 33/2016 filed by Rina Devi, Petitioner no. 2. Both the petitioners are alleged to have assaulted Prema Kuwar, but Prema Kuwar got only one injury that too of simple nature.

Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Karmchat P.S. Case No. 34/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
