28-10-2021 Heard learned counsel for the parties.

The petitioners seek bail in Basopatti P.S. Case No. 31 of 2021, registered for the offence under Section 414/34 of the Indian Penal Code.

As per the prosecution case, both the petitioners were apprehended with a stolen 4-wheeler (Tata Victa). It is submitted on behalf of petitioners that petitioners were falsely implicated in this case. The alleged vehicle belongs to one Madan Kumar Shah, who appeared in court and claimed his vehicle in question. Petitioner no. 1 was driver and petitioner no. 2 was helper and they were engaged by the local vehicle owner in need. Petitioners are in custody since 01.02.2021. Investigation is complete.

Patna High Court CR. MISC. No.42522 of 2021(2) dt.28-10-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Basopatti P.S. Case No. 31 of 2021.
