The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.
The petitioner, allegedly, caused injury with lathi at the head of the informant Dhananjay Yadav. The original injury report is not available. The supplementary injury reports vide Annexure-2 reveals that Doctor has found fracture of right finger which was grievous in nature and the rest injuries were simple in nature.
Submission is that there is no allegation of repetition of blow.
Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.52480 of 2016 (2) dt.07-12-2016 above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/Successor Court in connection with Kutumba Police Station Case No. 96 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
