The petitioners apprehend their arrest in connection with Patori P.S. Case No. 304 of 2017, registered under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code. The accusation is that, on 26.08.2017, informant, Jiyauddin Ansari, had gone at the house of Md. Sabir for making complaint about causing injury to his brother. In the meantime, Akbar and Akhtar came and attacked through knife at his head. At that time, petitioners, Md. Sabir Ansari, Md. Sddam Ansari, Md. Muntjir Ansari @ Mikki along with Suleman came having lathi, Farsa and knife and started to cause assault, in which, Rani Khatoon, wife of the informant, sustained injury. When Sakina Khatoon and Rustam, mother and cousin of the informant, rushed to save then they were
Patna High Court Cr.Misc. No.29054 of 2018(2) dt.10-05-2018 2/2 also assaulted. At that time, Akthar snatched gold chain from the neck of the informant.
Learned counsel for the petitioners submits that due to some dispute, occurrence took place, in which, petitioners' side also sustained injury, regarding which, Patori P.S. Case No. 303 of 2017 was instituted on 27.08.2017 on the basis of the written report of Azmari Khatoon, daughter of petitioner no. 1. Moreover, the injuries, as found on the person of the informant and others, are simple in nature. Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Patori P.S. Case No. 304 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
