JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 468 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, petitioner made interpolation in original papers and changed the name in the original election result.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that the forgery was committed in the year 2004 but the complaint petition was filed in the year 2006 with out any explanation for delay of two years. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.28907 of 2022(2) dt.26-09-2022 2/2 prayer for anticipatory bail and submits that petitioner approached this court for grant of anticipatory bail after15 years of the filing of the complaint petition.

Considering the nature of accusation, gravity of the offence and delayed filing of the petition, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
