The petitioner apprehends his arrest in connection with Dagarua P.S. Case No. 76 of 2016 registered under Sections 273 of the Indian Penal Code and 47(a) of Bihar Excise Act. The accusation is that in course of search, 15 bottles, each containing one liter, Country-made Foreign Liquor recovered from the dickey of the bus, which was owned by this petitioner.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that in course of checking of the bus, 15 bottles, each containing one litre Country-made Foreign Liquor recovered, at that time, petitioner
Patna High Court Cr.Misc. No.43728 of 2016 (2) dt.18-10-2016 2/2 was not present in the bus. Further submission is that petitioner has no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Purnea in connection with Dagarua P.S. Case No. 76 of 2016 (G.R. No. 2502 of 2016), subject to the condition as laid down under Section 438(2) of the Cr. P.C.
