He submits that by virtue of harmonious construction of Rules 103 and 58 of the Bihar Service Code he would be raising his claim for being granted pay and benefits of the post attached to Assistant Director, Mines, before respondent No. 4. The petitioner would be at liberty to stake his claim in view of the said provision discussed hereinabove or any order grounds that he may chose while making his claim. The writ petition stands disposed.
