The petitioners are apprehending their arrest in Basanahi P.S.Case No.44 of 2017 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.
It appears that the petitioners and family members of the informant are agnates and for constructing house over the land, scuffle took place between the parties for which a counter case has also been lodged by the mother of petitioner no.2. In the said occurrence family members of the petitioners sustained injuries. It has been submitted that the injuries report annexed with this application shows that the husband and son of the
Patna High Court Cr.Misc. No.50425 of 2017 (2) dt.30-10-2017 2/2 informant sustained simple injuries and the family members of the petitioners' side also sustained injuries. It is further submitted that the petitioners have clean antecedent except petitioner no.1 who is an accused in Basanahi P.S.Case No.33/92.
Considering the land dispute in between the parties who are agnates and simple nature of injuries prayer of anticipatory bail is allowed. Let the petitioners, above named, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M.-IV, Saharsa, in Basanahi P.S.Case No.44/17 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
