JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail in connection with Sessions Trail No. 351 of 2019 arises out of Munger Muffasil P.S. Case No. 413 of 2018 registered for the offences punishable under Sections 121, 379, 414, 120(B), 34 of the Indian Penal Code and Sections 25(1-A), 25(1-AA), 25(1-B)A, 26, 35 of the Arms Act.

The petitioner is in custody since 23.11.2018. His prayer for grant of regular bail was earlier rejected by this Court by an order dated 11.12.2019 passed in Cr. Misc. No. 48322 of 2019 with an observation that if in the meanwhile, there was no substantial progress at the trial, he shall be at liberty to renew his prayer for bail after six months. This is the reason why, the petitioner has filed this application, renewing his prayer for

Patna High Court CR. MISC. No.28363 of 2020(3) dt.24-02-2021 2/2 grant of regular bail.

A report dated 28.01.2021, as called for from the Court below, as regards present status of the trial has been submitted by learned Addl. District and Sessions Judge-V, Munger, from which it appears that though charge has been framed, no witness has so far been examined.

Considering the observation made by this Court in the order dated 11.12.2019 and the fact that there was no substantial progress at the trial, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Sessions Judge, Munger in connection with Sessions Trial No. 351 of 2019 arising out of Munger Muffasil P.S. Case No. 413 of 2018.

It is, however, observed that if the petitioner fails to appear before the Court below on the date, fixed at the trial, his bail bond shall be liable to be cancelled.
