Mr. Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-12-2017 Heard learned counsels for the petitioner and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 324, 504, 307, 448 and 379 of the IPC.
The prosecution case is that 23.05.2017, the goat of the informant Shankar Choudhary had strayed into the poultry farm of Brij Mohan who caught the goat and started penetrating thorn into the body of the goat. The informant and his wife went to make protest, but were pushed and shoved up by Brij Mohan. It is further alleged that next day in the morning, accused persons, named in the fardbeyan, armed with deadly weapon arrived at the house of the informant and threatened to kill the informant. They also assaulted the informant and took away the ornaments. It is submitted by learned counsel for the petitioner that the
Patna High Court Cr.Misc. No.59903 of 2017(2) dt.13-12-2017 2/2 petitioner is the agnate of the informant. For petty dispute, the accusation has been levelled. There is counter version of the occurrence also, being Jamhore P.S. Case No. 57 of 2017. Moreover, co-accused Mohan Paswan and others have been granted anticipatory bail by a co-ordinate Bench of this Court, vide Cr. Misc. No. 48380 of 2017. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.
Considering the nature of accusation, co-accused being granted anticipatory bail by a co-ordinate Bench of this Court, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Jamhore P.S. Case No. 54 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
