JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 This is an application for grant of anticipatory bail in connection with Bettiah Town P.S. Case No. 165 of 2018, disclosing offences under Sections 420, 406, 341, 323, 504 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.
Allegation against the petitioner is that he has taken Rs.12 lacs for sell of a piece of land and thereafter not executed the sale-deed and further allegation is that he issued two cheques total amounting to Rs. 4,50,000/-, but that also bounced.
Submission of learned counsel for the petitioner is that he has not taken that amount and at best he has taken amount of Rs.3,25,000/- and other allegation is false and

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner stating that the for purchase of a last an agreement was made which was signed by the petitioner and also cheques were issued by the petitioner, which have bounced and the petitioner has not executed the sale-deed and not returning the money that shows the involvement of the petitioner from the beginning.
Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.
Accordingly, this application is dismissed.
