JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-10-2020 In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application through Video Conferencing, that he would remove the defect(s), as pointed out by the stamp reporter, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard Mr. Shashi Bhsuhan Kumar, learned counsel appearing for the petitioner, Mr. Nawal Kishore Prasad, learned A.P.P. appearing for the State as well as Mr. Shailesh Kumar Singh, learned counsel appearing for the informant through Video Conferencing.

The petitioner is accused in connection with Gardanibagh P.S. Case No. 297 of 2019, registered under

Patna High Court CR. MISC. No.25261 of 2020(3) dt.07-10-2020 2/2 Sections 341, 323, 504, 379 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected on merit vide order dated 05.03.2020 passed in Cr. Misc. No. 72820 of 2019 by this Court with an observation that petitioner would be at liberty to renew his prayer for bail after completing one year in jail custody and in the present case, petitioner is in custody since 06.07.2019, therefore, he is in custody for more than years.

Having regard to the facts and the circumstances of the case and the observation made in the order dated 05.03.2020 passed in Cr. Misc. No. 72820 of 2019, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Patna, in connection with Gardanibagh P.S. Case No. 297 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
