JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 This is an application for grant of anticipatory bail in connection with Muffasil (Mahadeva) P.S. Case No.63 of 2019, disclosing offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 41/i of the Bihar Prohibition and Excise Act.
Allegation is of recovery of 16.625 liters of foreign liquor from the house of petitioner.
Submission of the learned counsel for the petitioner is that it is joint house and he has falsely been implicated in this case.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there is prima facie case against the petitioner.
Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant

No.26417 of 2019(3) dt.08-07-2019 2/2 privilege of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail, which will be considered by the learned court below, on its owner, and if possible, be disposed of on the same day.
