====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-01-2021 Heard learned counsel for the petitioners and State. The petitioners are apprehending arrest in connection with Sonbarsa P.S. Case No. 218 of 2019 for the offence under Sections 363, 366(A)/34 of the Indian Penal Code. The petitioners are the father, mother and brother-inlaw of the accused Ravi Kishan. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent.

Referring to the prosecution case, learned counsel for the petitioners submits that the allegation of the informant that his daughter was 14 years was found untrue and she is a major, aged about 22 years. He further submits that the victim in her

Patna High Court CR. MISC. No.28444 of 2020(2) dt.18-01-2021 2/2 statement recorded under Section 164 of the Cr.P.C. she stated that she is aged about 22 years and is residing in the house of Ravi Kishan (son of petitioner no.1).

Considering the aforesaid, the petitioners named above, in the event of arrest or surrender before the court below within one month from the date of receipt of a copy of this order, are directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 218 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anil Kumar Upadhyay, J) uday/- U T
