2. The petitioner seeks bail in connection with Sikandra P.S. Case No. 264/2023 registered for the offence punishable under Sections 147/149/341/323/307/504/506 of the Indian Penal Code and Section 27 of the Arms Act.

3. The deceased sustained injuries at the hands of the accused persons particularly Lakhan Tanti and the petitioner. Initially, the case was registered under Section 307 of the Indian Penal Code. During the treatment, the deceased died after eight days.

4. Learned counsel for the petitioner submits that no offence under Section 302 of the Indian Penal Code is made out against the petitioner.

5. Learned counsel for the informant has vehemently opposed the prayer for bail.

6. The petitioner is in custody since 10.01.2024.

7. Considering the fact that the deceased died after eight days of the occurrence, this may not be a case under Section 302 of the Indian Penal Code, let the petitioner above named be released on bail after framing of charge, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Jamui in connection with Sikandra P.S. Case No. 264/2023.
