The petitioners apprehend their arrest in connection with Sikroul P. S. Case No. 61 of 2017 instituted under Sections 147, 148, 149, 307, 323, 324, 341, 354, 379, and 504 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is that on account of protest made by the
Patna High Court Cr.Misc. No.53131 of 2017 (3) dt.10-11-2017 2/3 informant with regard to cutting of ridge of his field, accused persons assaulted the informant. It is alleged that Santosh Kumar Sing opened fire but did not hit anybody, Prakash Singh gave Farsa blow over the head of the informant's father, Rajesh Kumar gave a lathi blow to Binod Singh, uncle of the informant, on the back.
Learned counsel for the petitioners submits that there is land dispute between both sides and there is case and counter case and no any specific allegation against petitioners no. 4 to 8 and petitioners no. 1 and 2 assaulted the informant's mother by leg, fist and slaps and the injuries are simple and nature and petitioner no. 3 is said to have assaulted the uncle of the informant but the injury is simple in nature and the petitioners have no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioners, namely, Bimla Devi, Kalawati Devi @ Lilawati Devi, Rajesh Kumar Singh @ Rajesh Singh, Rakesh Kumar Singh @ Rakesh Kumar @ Rakesh Singh, Vikash Kumar @ Abhishek Kumar Singh @ Vikash Kumar Singh @ Abhshek Kumar, Abhimanyu Kumar Singh, Mishri Singh and Ramashish Singh, in the event of arrest or surrender before the court below within four weeks from today, be released on bail
Patna High Court Cr.Misc. No.53131 of 2017 (3) dt.10-11-2017 3/3 upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Buxar in connection with Sikroul P.S.Case No. 61 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
