Petitioner seeks regular bail in connection with Laxmipur P.S. Case No. 128 of 2020 registered for the offence under Sections 341, 447, 448, 323 , 324 , 307, 379, 504, 506 / 34, 354 of the I.P.C.
Petitioner has allegedly assaulted by means of iron rod on the head of the son of the informant.
Learned counsel for the petitioner submits that both the parties are neighbours and there is land dispute between them. He next submits that there is case and counter case between the parties inasmuch as Laxmipur P.S. Case No. 129 of 2020 has been lodged by uncle of the petitioner Dashrath Paswan against the informant and others. Petitioner is in custody
Patna High Court CR. MISC. No.38032 of 2021(2) dt.07-01-2022 2/2 since 08/03/2021, having no criminal antecedent and charge sheet has already been submitted.
Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that both the parties are neighbours, there is previous land dispute between them, petitioner is in custody since 08/03/2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Laxmipur P.S. Case No. 128 of 2020.
