JUSTICE SATYAVRAT VERMA ORAL ORDER 11-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Special Excise Case No. 36 of 2021 arising out of Dagarua P.S. Case No. 13 of 2021 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 11.01.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 2163.240 litres of liquor from a truck and the driver of the truck gave mobile number of a person who loaded the liquor at Sonapur at West Bengal.

No.37887 of 2021(3) dt.11-01-2022 2/2 Learned counsel for the petitioner submits that the petitioner is the driver of the said truck and was not knowing what was being loaded in the truck and it was only after the liquor was recovered the driver came to know that it was liquor which was loaded by the said persons.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 11.01.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Purnea in connection with Special Excise Case No. 36 of 2021 arising out of Dagarua P.S.
