Petitioner is apprehending arrest in connection with Excise Case No. 95 of 2020 arising out of Korma P.S. Case No. 13 of 2020 for the offence under sections 272 and 273 of the Indian Penal Code and Section 30(a)(d) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case 10 liters of country made liquor was recovered from the river side and not from the conscious possession of this petitioner.

Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below

Patna High Court CR. MISC. No.28453 of 2020(2) dt.18-01-2021 2/2 within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, Sheikhpura, in connection with Excise Case No. 95 of 2020 arising out of Korma P.S. Case No. 13 of 2020 subject to the condition that the petitioner shall deposit Rs. 10000/- cash in the court below and the amount of Rs. 10000/-deposited by the petitioner shall abide by final outcome of the pending criminal case with further condition as laid down under section 438(2) of the Cr.P.C.
