JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 09-02-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends his arrest in connection with Kanti (Panapur O.P.) P.S. Case No. 426 of 2020, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 427, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

The informant Sanjay Kumar, lodged FIR with allegation that accused persons named in the FIR entered into his boundary after dismantling it by JCB machine. Then ransacked the articles such as food grains, gas cylinder, fan etc. The further allegation is that co-accused Ashok Thakur, Anil Thakur, Bittu Thakur, Manish

Learned counsel for the petitioner has submitted that there is land dispute between the parties and allegation against the petitioner is general and omnibus. The specific allegation of assault is against co-accused Anil Thakur, Ashok Thakur, Bittu Thakur and Manish Thakur and not on the present petitioner. Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 2nd, West, Muzaffarpur in connection with Kanti (Panapur O.P.) P.S. Case No. 426 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
