The petitioner apprehends his arrest in a case registered under Sections 379 and 411 of the Indian Penal Code.

Two accused persons are said to have snatched the mobile and purse containing Rs.6000/- and other documents of the informant. Out of them, one namely Aakash Kumar was apprehended with the mobile and as per the revelation of the apprehended accused, petitioner managed to escape with purse. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case due to

Patna High Court CR. MISC. No.27700 of 2019(2) dt.01-05-2019 2/2 animosity. No incriminating article has been recovered from the conscious physical possession of the petitioner. He was not apprehended on the spot. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring the disclosure made by the apprehended accused Aakash Kumar. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway J.M. 1st Class, Gaya in connection with Rail Thana Jehanabad P.S. Case No. 07 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
