2. The petitioners are custody in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. As per allegation in the FIR, the younger brother of the informant went missing from 11.08.2023 and the dead body of the younger brother of the informant was found on the next day in the courtyard and on suspicion, accused persons were named in the FIR for committing the murder of the deceased.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He next

No.33126 of 2024(3) dt.31-07-2024 2/2 submits during investigation, nobody has come forward in support of the prosecution version rather the sister-in-law of the informant, namely, Archana Kumari has categorically stated that the deceased Vishal Kumar came at her house on 11.08.2023 at about 9 P.M. who stay in the night in her house and in the morning his brother, i.e., the informant came and scolded the deceased to not marry with Archana Kumari and in that retaliation, the deceased committed suicide in absence of Archana Kumari. Petitioners have clean antecedent and they are in custody since 24.11.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioners.

Considering the aforesaid facts and circumstances of the case and period of custody of the petitioners as also having clean antecedent, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Raghopur P.S. Case No. 189 of 2023.
