1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners seek bail in a case registered for the offences punishable under Sections 80, 103(2) and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and are in custody since 03.09.2024 and the informant alleges that his daughter was married to Md. Kalam son of petitioner no. 1 about two months back. Further, on 30.08.2024, at night, his daughter was killed by strangulation on account of non-fulfillment of the demand of dowry.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that informant is not an eyewitness to the occurrence and the entire allegation hinges around suspicion. It is next submitted that a specific plea has been taken at para 14 of the bail application, that the deceased was not happy with her marriage with the son of the petitioner no. 1, as such, she committed suicide. It is also submitted that from perusal of the allegation as alleged in the FIR, it would manifest that even demand of dowry is general and omnibus in nature. It is submitted that whenever any dispute arises in between the husband and the wife and the occurrence of the nature as alleged takes place, the entire family members are implicated in a mechanical manner. It is further submitted that petitioners are mother-in-law, elder brother-in-law and sister-inlaw of the deceased. It is next submitted that charge-sheet has been submitted.
5. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.
6. Considering the submissions made by the learned counsel appearing on behalf of the petitioners, the petitioners, above named, are directed to be released on bail on furnishing
Patna High Court CR. MISC. No.29558 of 2025(3) dt.06-08-2025 3/3 bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending in connection with Rudrapur P.S. Case No. 99 of 2024.
