1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner has antecedent of two cases and is in custody since 28.06.2024 and the informant alleges that he along with his friend were intercepted by unknown criminal who looted their articles along with the motorcycle on point of gun.
4. Learned counsel for the petitioner submits that FIR was again unknown and the name of the petitioner transpired in the confessional statement of apprehended accused which does not have any evidentiary value in the eye of law.

5. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that looted mobile was recovered from the possession of the petitioner.
6. Considering the submission made by the learned A.P.P. for the State and also taking into consideration the criminal antecedent of the petitioner, the Court, for the present, is not inclined to release the petitioner on bail in connection with Gurua P.S. Case No. 219 of 2024 pending in the Court of learned Judicial Magistrate, 1st Class, Sherghati, Gaya/Successor Court.
7. Hence, the prayer for bail is rejected.
