The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 47(a) of the Excise Act.
From the house of this petitioner, country made liquor was recovered.
Submission is that brother of the petitioner is also an accused in this case and recovery was not made from his conscious possession.
Let, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on
Patna High Court Cr.Misc. No.51951 of 2016 (2) dt.20-12-2016 2/2 anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram/Successor Court in connection with Excise Case No. 145 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
