This present application has been filed for quashing of the impugned order dated 15.03.2021 passed by the learned Additional Sessions Judge-X, Gaya whereby and whereunder the charge has been framed against the petitioner under Section 376 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has committed no offence and he has falsely been implicated in this case.

This Court has gone through the entire materials available on record. It is apparent that after completing the investigation, chargesheet has been submitted against this petitioner.

No.43746 of 2021(2) dt.05-05-2022 2/2 This Court finds no illegality in the impugned order as learned Additional Sessions Judge-X, Gaya is well within the jurisdiction to take charge, if the case, prima facie, is found true against the petitioner. Hence, this Court is not inclined to interfere at this stage.
