The petitioner apprehends his arrest in connection with Rajiv Nagar P.S. Case No.140 of 2017 registered under Sections 290 and 294 of the Indian Penal Code besides Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act.

The accusation is that on receiving secret information about running of the flesh trade at the rented premises by Rahul Kumar at Friends Colony, Road No.3, Rajeev Nagar, Patna, the informant alongwith other police officials reached there and searched the ground floor of the house and found six ladies belonging to the different places, and three men in an

Patna High Court Cr.Misc. No.51498 of 2017 (2) dt.02-11-2017 2/2 objectionable position and apprehended them.

Some objectionable items were also recovered from there. On query, it was detected that the house belongs to the petitioner. Learned counsel appearing on behalf of the petitioner submits that, admittedly, the petitioner is the owner of the house, the ground floor of which was given to Rahul Kumar on rent and the petitioner, who used to live at the first floor of the house, had no knowledge about running of flesh trade at the ground floor of the house by Rahul Kumar. The petitioner, who is aged about 70 years, has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, Judicial Magistrate, First Class, Patna, in connection with Rajiv Nagar P.S. Case No.140 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
