JUSTICE HARISH KUMAR ORAL ORDER 22-12-2022 Heard Mr. Pramod Kumar Bhartiya, learned counsel for the petitioner; Mr. Yashraj Bardhan, learned counsel for the Patna Municipal Corporation and learned counsel for the State. Learned counsel for the petitioner submits that though the petitioner superannuated on 01.11.1994 from the post of Sectional Officer of the Patna Municipal Corporation, however, till date certain retiral benefits have not been bestowed upon him causing irreparable loss and mental agony. It is further submitted that for redressal of his grievance, he had also approached before the concerned respondent authority, however, the same has also not been taken care of.

Patna High Court CWJC No.9671 of 2019(3) dt.22-12-2022 2/2 Learned counsel for the Corporation submits that the petitioner superannuated way back in the year 1994 and he approached before this Court after twenty five years. It would be proper, if the petitioner would file a representation before the respondent no. 3, the same would be considered and disposed of.

In view of the submissions made on behalf of the parties, the present writ application stands disposed of with a direction to the petitioner to file a representation before the respondent no. 3 within a period of four weeks. If the petitioner files the representation, respondent no. 3 shall dispose of the same within further period of four weeks by a reasoned and speaking order in accordance with law. It is needless to say that if any of the claim of the petitioner would be found admissible, the actual benefit must be paid to him within the aforesaid period.

Accordingly, the present writ application stands disposed of with the aforesaid directions and observation. (Harish Kumar, J) shakir/- U
