17-10-2017 Heard Mr. Shakil Ahmad Khan, learned counsel for the petitioner and Dr. Mrityunjay Kumar Gautam, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Dighwara P.S. Case No. 119 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Sections 30, 38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that petitioner has falsely been made accused in a case of recovery of about 18 liters of Indian make foreign liquor was shown from bush of a field and thereafter, he has been made accused. He submits that petitioner was not having any connection from the recovered articles nor he was any
Patna High Court Cr.Misc. No.49600 of 2017(2) dt.17-10-2017 2/2 connection from the field, from where, recovery was shown and petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition.
Considering the facts & circumstances as well as clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Mantu Kumar be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 6th Saran at Chapra in connection with Dighwara P.S. Case No. 119 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C.
