Heard learned counsel for the appellant and learned Special P.P.for the State.

The appellant's prayer for bail was earlier rejected on 27.11.2019 by the court of A.D.J.-I-Cum-Special Judge, Nalanda at Biharsharif. Thereafter, he had filed a bail application before this Court in Cr.Misc. No.87088 of 2019. By order dated 28.02.2020, this Court rejected the appellant's bail application. Thereafter, the offences under the provisions of S.C./S.T. Act have been added and chargesheet has been submitted in respect of the said offences.

Having regard to the aforesaid circumstances, Mr. Rudal Singh, counsel for the appellant submits that the appellant

Patna High Court CR. APP (SJ) No.2897 of 2021(6) dt.06-09-2021 2/2 would now be availing the remedy of bail before the Special Court under the S.C./S.T. Act.

Recording the aforesaid submissions, appeal is disposed of with liberty, as prayed for.

This Court would expect that the appellant's counsel would honour his undertaking in the instant proceedings regarding supply of the requisite court fee etc. within two weeks from the date he is called upon to do so by the office. (Madhuresh Prasad, J) PNM U T
